TALAY — Gizlilik Politikası

Bu belge, TALAY mobil uygulamasının (iOS ve Android) hangi verileri, ne amaçla işlediğini açıklar. TALAY tamamen çevrimdışı öncelikli çalışacak şekilde tasarlanmıştır: bir kullanıcı hesabı sistemi yoktur, verileriniz varsayılan olarak yalnızca kendi cihazınızda saklanır.

1. Hangi Verileri Topluyoruz?

1.1 Konum (GPS)

Uygulama, aşağıdaki özellikler için cihazınızın konumuna erişir:

• Harita üzerinde canlı konum, hız (SOG) ve rota (COG) göstermek,
• Acil durumda (Mayday/Pan-Pan) çağrı metnine koordinatlarınızı otomatik eklemek,
• Hava durumu bilgisini bulunduğunuz konuma göre getirmek,
• Seyir defteri kaydı oluştururken konumu otomatik eklemek,
• Demir Nöbeti kuruluyken teknenin salınım çemberinin dışına çıkıp çıkmadığını denetlemek (madde 1.1.2),
• İz kaydı tutmak (madde 1.1.1).

Konum verileriniz cihazınızdaki yerel bir veritabanında (SQLite) saklanır ve bize ait hiçbir sunucuya gönderilmez — kullanıcı verisi alan bir sunucumuz yoktur. Ancak aşağıdaki özellikleri kullandığınızda sorgulanan koordinatlar ilgili üçüncü taraf servise iletilir: Hava ekranını açtığınızda veya jurnal kaydı oluşturduğunuzda konumunuz Open-Meteo'ya; derinlik katmanını açtığınızda ekranda görünen alanı kapsayan koordinat ızgarası OpenTopoData'ya gönderilir. Harita sağlayıcıları da görüntülediğiniz bölgeyi ve IP adresinizi görür. Ayrıntılar madde 2'dedir.

Arka planda konum takibi (isteğe bağlı): Uygulama ilk kurulumda veya Ayarlar ekranından, uygulama arka plandayken de son konumunuzu güncel tutmayı isteyip istemediğinizi sorar. Bu özellik varsayılan olarak kapalıdır ve yalnızca siz açtığınızda çalışır. Açıldığında:

• Yalnızca en son konum saklanır — önceki konum üzerine yazılır. Bu özellik bir "rota geçmişi" tutmaz. (Uygulamanın ayrı bir iz kaydı özelliği vardır; madde 1.1.1'e bakınız.)
• Amaç, uygulamaya geri döndüğünüzde harita ve acil durum ekranının güncel bir koordinatla açılması ve Demir Nöbeti kuruluysa ekran kilitliyken de denetimin sürmesidir (madde 1.1.2). Nöbet kuruluyken konum daha sık alınır.
• Dilediğiniz zaman Ayarlar'dan kapatabilirsiniz; kapattığınızda arka plan takibi derhal durur.
• Android'de bu özellik açıkken, işletim sistemi kuralları gereği kalıcı bir bildirim gösterilir (şeffaflık amacıyla) — gizlenemez, bu Android'in kendi güvenlik gereğidir.

1.1.1 İz Kaydı (Seyir İzi)

Arka plan takibinden ayrı olarak uygulamanın bir iz kaydı özelliği vardır: uygulama ekranda açıkken — hangi sekmede olursanız olun — geçtiğiniz noktaları kaydeder ve bunları "Kayıtlı İzler" listesinde saklar. Uygulama arka plandayken iz kaydedilmez. İzleri GPX dosyası olarak dışa aktarabilirsiniz (madde 1.5).

• Bu özellik varsayılan olarak açıktır. Harita ekranındaki iz düğmesinden kapatabilirsiniz; kapattığınızda o anki kayıt sonlandırılır ve yeni nokta yazılmaz.
• Kaydedilen izler — zaman damgalı koordinatlar ve o andaki hız — yalnızca cihazınızdaki yerel veritabanında tutulur. Bize ait bir sunucuya gönderilmez; zaten böyle bir sunucumuz yoktur.
• Saklama süresi: izler otomatik olarak silinmez. Siz silene kadar cihazınızda kalırlar.
• Silme: "Kayıtlı İzler" listesinden her izi tek tek silebilirsiniz. Uygulamayı cihazınızdan kaldırdığınızda tüm izler de silinir.

1.1.2 Demir Nöbeti

Demir Nöbeti'ni kurduğunuzda demirin mevkii ve seçtiğiniz salınım yarıçapı yalnızca cihazınızda saklanır. Teknenin çemberin dışına çıkıp çıkmadığı cihazınızda hesaplanır; bu hesap için hiçbir konum bir sunucuya gönderilmez.

• Uygulama açıkken alarm cihazda sesli çalar.
• Ekran kilitliyken veya uygulama arka plandayken denetim yalnızca arka planda konum takibi açıksa sürer. Alarm, cihazınızın işletim sistemi üzerinden gösterilen yerel bir bildirimdir; bir bildirim sunucusu kullanılmaz. Bildirim için işletim sistemi sizden ayrıca izin ister.
• Nöbeti kaldırdığınızda demir mevkii silinir.

1.2 Gemi/Tekne Profili

Acil durum mesajlarında kullanılmak üzere isteğe bağlı olarak girdiğiniz gemi adı ve kişi sayısı (POB) bilgisi, yalnızca cihazınızda saklanır. Bu bilgi hiçbir sunucuya gönderilmez; yalnızca siz "Metni Kopyala" butonuna bastığınızda, oluşturulan metni kendi telsizinize/mesajlaşma uygulamanıza yapıştırmanız için panoya kopyalanır.

1.3 Seyir Defteri ve Kayıtlı Sahalar

Oluşturduğunuz seyir defteri kayıtları (başlık, not, o anki hava durumu ve konum bilgisiyle birlikte) ve haritada çizip kaydettiğiniz sahalar (örn. demir yeri, av sahası) yalnızca cihazınızdaki yerel veritabanında tutulur. Bu veriler hiçbir sunucumuza senkronize edilmez.

1.4 Çökme (Crash) ve Teknik Tanı Verisi

Uygulamanın beklenmedik şekilde kapanması durumunda, sorunu teşhis edip düzeltebilmemiz için Sentry adlı bir üçüncü taraf hizmeti aracılığıyla teknik hata raporu (hatanın oluştuğu kod konumu, cihaz modeli, işletim sistemi sürümü, uygulama sürümü) toplanır. Bu raporlar:

• Konum, gemi adı, POB, jurnal metni ve acil durum çağrı metni gönderim öncesinde redakte edilir — bilinen alanlar, URL parametreleri ve koordinat biçimindeki metinler taranır. Bunu bilerek göndermeyiz; ancak biçimsel bir garanti değil, bilinen kalıplar üzerinde bir temizliktir,
• Avrupa Birliği sınırları içinde barındırılan sunuculara gönderilir,
• Yalnızca hata ayıklama amacıyla kullanılır.

1.5 Dışa Aktarma ve Paylaşma

İzlerinizi ve rotalarınızı GPX dosyası olarak, seyir defteri kayıtlarınızı ise metin olarak dışa aktarabilirsiniz. Bu veriler yalnızca siz dışa aktarmayı seçtiğinizde, cihazınızın paylaşım menüsünden seçtiğiniz uygulamaya veya konuma gider. TALAY bu dosyaları kendiliğinden hiçbir yere göndermez; gönderildikten sonra seçtiğiniz uygulamanın gizlilik koşulları geçerlidir.

2. Üçüncü Taraf Hizmetler

TALAY, temel işlevlerini yerine getirebilmek için aşağıdaki üçüncü taraf servislere ağ istekleri yapar. Bu servisler, herhangi bir internet isteğinde olduğu gibi doğal olarak IP adresinizi ve (harita servisleri için) görüntülediğiniz bölgeyi görebilir:

TALAY hiçbir reklam ağı, pazarlama amaçlı takip (tracking) SDK'sı veya analitik/kullanıcı davranışı izleme aracı içermez. Verileriniz satılmaz, kiralanmaz veya pazarlama amacıyla paylaşılmaz.

3. Verilerinizin Kontrolü

• Konum izni: cihazınızın Ayarlar uygulamasından istediğiniz zaman geri alabilirsiniz.
• Arka plan takibi: uygulama içi Ayarlar ekranından tek dokunuşla kapatabilirsiniz.
• Seyir defteri kayıtları ve kayıtlı sahalar: ilgili ekranlardan tek tek silebilirsiniz.
• Çevrimdışı harita önbelleği: Ayarlar → "Önbelleği Temizle" ile silebilirsiniz.
• Tüm yerel verileri kalıcı olarak silmek için: uygulamayı cihazınızdan kaldırmanız yeterlidir — hiçbir veri bizim kontrolümüzdeki bir sunucuda kalmaz.

4. Çocukların Gizliliği

TALAY çocuklara yönelik bir uygulama değildir ve bilerek 13 yaşın altındaki çocuklardan veri toplamaz.

5. Bu Politikadaki Değişiklikler

Uygulamaya yeni özellikler eklendikçe bu politika güncellenebilir. Önemli değişiklikler bu sayfada yayınlanacaktır.

6. Hukuki Sebepler ve Veri Toplama Yöntemi

Kişisel verileriniz, uygulamayı kullanmanız sırasında doğrudan cihazınız üzerinden, otomatik veya kısmen otomatik yollarla elde edilir. Bize form doldurarak veya başka bir kanaldan veri iletmeniz gerekmez.

7. Saklama Süreleri

• Cihazınızdaki veriler (jurnal, rotalar, sahalar, işaretçiler, izler, gemi profili, harita önbelleği): siz silene veya uygulamayı kaldırana kadar saklanır. Süre sınırı yoktur, çünkü veriler bizde değil sizdedir.
• Arka plan konumu: yalnızca en son konum tutulur; her yeni konum bir öncekinin üzerine yazılır. Geçmiş biriktirilmez.
• Demir Nöbeti: demir mevkii nöbet kaldırılana kadar cihazda tutulur, sonra silinir.
• Çökme raporları (Sentry): Sentry'nin bu proje için yapılandırılmış saklama süresi kadar (varsayılan 90 gün), ardından otomatik silinir.
• Üçüncü taraf sorguları (Open-Meteo, OpenTopoData, harita sağlayıcıları, talay.app'in barındırma sağlayıcısı Hostinger): bu servislerin kendi günlük kayıt politikalarına tabidir; bizim kontrolümüzde değildir.

8. Yurt Dışına Aktarım

Uygulamanın kullanıcı verisi alan bir sunucusu yoktur, ancak madde 2'de listelenen servisler yurt dışında yerleşiktir ve bir özelliği kullandığınızda ilgili veri o servise ulaşır:

• Sentry: Avrupa Birliği içinde barındırılan sunucular (Frankfurt). AB, GDPR kapsamında yeterli korumaya sahiptir.
• Open-Meteo: Almanya/AB.
• OpenTopoData, OpenStreetMap, OpenSeaMap, MapTiler: AB ve/veya ABD.
• Hostinger (talay.app): sunucu konumu ve aktarım güvenceleri Hostinger'ın kendi politikasına tabidir.
• Apple Maps (iOS) / Google Maps SDK (Android): ilgili sağlayıcının kendi politikası ve aktarım güvenceleri geçerlidir.

Bu aktarımlar, KVKK m.9 kapsamında açık rızanıza (konum izni ve ilgili özelliği kullanmanız) dayanır. İlgili özelliği kullanmadığınızda aktarım gerçekleşmez.

9. Haklarınız

KVKK m.11 uyarınca kişisel verilerinizle ilgili şu haklara sahipsiniz: işlenip işlenmediğini öğrenme; işlenmişse bilgi talep etme; işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme; yurt içinde/yurt dışında aktarıldığı üçüncü kişileri bilme; eksik veya yanlış işlenmişse düzeltilmesini isteme; silinmesini veya yok edilmesini isteme; düzeltme/silme işlemlerinin aktarıldığı üçüncü kişilere bildirilmesini isteme; münhasıran otomatik sistemlerle analiz edilmesi suretiyle aleyhinize bir sonuç doğmasına itiraz etme; kanuna aykırı işleme sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme.

GDPR kapsamında ayrıca erişim (m.15), düzeltme (m.16), silme (m.17), işlemenin kısıtlanması (m.18), veri taşınabilirliği (m.20) ve itiraz (m.21) haklarına; rızaya dayalı işlemelerde ise rızanızı dilediğiniz an geri çekme hakkına sahipsiniz.

Uygulamada bu hakları doğrudan kullanabilirsiniz: verileriniz cihazınızda tutulduğu için erişim, düzeltme ve silme işlemlerini uygulama içinden kendiniz yapabilirsiniz (jurnal/rota/saha kayıtlarını silmek, Ayarlar'dan harita önbelleğini temizlemek, konum iznini geri almak veya uygulamayı kaldırmak). Bizim bir kopyanız bulunmadığı için bu talepleri bizim yerine getirmemiz gerekmez.

Yine de bir talebiniz veya şikâyetiniz olursa aşağıdaki adresten ulaşabilirsiniz. Ayrıca Kişisel Verileri Koruma Kurulu'na (KVKK) veya bulunduğunuz AB üye ülkesindeki veri koruma otoritesine şikâyette bulunma hakkınız saklıdır.

TALAY — Privacy Policy

This document explains what data the TALAY mobile app (iOS and Android) processes, and why. TALAY is built to be offline-first: there is no user account system, and your data stays on your own device by default.

1. What Data We Collect

1.1 Location (GPS)

The app accesses your device's location for the following features:

• Showing your live position, speed (SOG), and course (COG) on the map,
• Automatically including your coordinates in Mayday/Pan-Pan distress messages,
• Fetching weather data for your current location,
• Automatically attaching position data to logbook entries,
• Checking, while the Anchor Watch is set, whether the boat has left its swing circle (section 1.1.2),
• Recording tracks (section 1.1.1).

Your location is stored in a local database (SQLite) on your device and is never sent to any server we operate — we run no server that receives user data. However, when you use the following features the queried coordinates are sent to the relevant third-party service: opening the Weather screen or creating a logbook entry sends your position to Open-Meteo; enabling the depth layer sends a grid of coordinates covering the visible area to OpenTopoData. Map providers also see the area you are viewing and your IP address. See section 2 for details.

Background location tracking (optional): On first launch, or from the Settings screen, the app asks whether you want your last known position kept up to date even while the app is in the background. This feature is off by default and only runs if you turn it on. When enabled:

• Only your most recent position is stored — it overwrites the previous one. This feature keeps no route history. (The app does have a separate track recording feature; see section 1.1.1.)
• The purpose is for the map and emergency screen to open with an accurate coordinate when you return to the app, and, if the Anchor Watch is set, for the watch to continue while the screen is locked (section 1.1.2). Position is taken more often while a watch is set.
• You can turn it off anytime from Settings; background tracking stops immediately.
• On Android, while this is on, the operating system requires a persistent notification for transparency — this cannot be hidden, as it's an Android platform requirement, not our choice.

1.1.1 Track Recording

Separately from background tracking, the app has a track recording feature: while the app is open on screen — whichever tab you are on — it records the positions you pass through and keeps them in the "Recorded Tracks" list. No track is recorded while the app is in the background. Tracks can be exported as GPX files (section 1.5).

• This feature is on by default. You can switch it off with the track button on the map screen; doing so closes the recording in progress and no further points are written.
• Recorded tracks — timestamped coordinates and the speed at each point — are held only in the local database on your device. They are not sent to any server we operate; we do not run one.
• Retention: tracks are not deleted automatically. They stay on your device until you delete them.
• Deletion: you can delete any track individually from the "Recorded Tracks" list. Removing the app from your device deletes all of them.

1.1.2 Anchor Watch

When you set the Anchor Watch, the anchor position and the swing radius you chose are stored only on your device. Whether the boat has left the circle is worked out on your device; no position is sent to any server for it.

• While the app is open, the alarm sounds on the device.
• With the screen locked or the app in the background, the watch continues only if background location tracking is on. The alarm is a local notification shown by your device's operating system; no notification server is involved. The operating system asks separately for permission to show it.
• When you stow the watch, the anchor position is deleted.

1.2 Vessel Profile

The vessel name and persons-on-board (POB) count you optionally enter for emergency messages are stored only on your device. This information is never transmitted to any server; it is only copied to your clipboard when you tap "Copy Text," for you to paste into your own radio/messaging app.

1.3 Logbook and Saved Areas

Logbook entries you create (title, notes, along with the weather and position at the time) and areas you draw and save on the map (e.g. anchorages, fishing grounds) are kept only in your device's local database. None of this is synced to any server of ours.

1.4 Crash and Diagnostic Data

If the app crashes unexpectedly, a technical error report (the code location of the error, device model, OS version, app version) is collected via a third-party service called Sentry so we can diagnose and fix the issue. These reports:

• Have position, vessel name, POB, logbook text and the composed distress call redacted before transmission — known fields, URL parameters and coordinate-shaped text are scrubbed. We do not send them deliberately; this is scrubbing on known shapes rather than a formal guarantee,
• Are sent to servers hosted within the European Union,
• Are used solely for debugging purposes.

1.5 Exporting and Sharing

You can export your tracks and routes as GPX files, and your logbook entries as text. This data leaves your device only when you choose to export it, going to the app or location you pick in your device's share menu. TALAY sends these files nowhere on its own; once sent, the privacy terms of the app you chose apply.

2. Third-Party Services

To provide its core functionality, TALAY makes network requests to the following third-party services. As with any internet request, these services can naturally see your IP address and (for map services) the area you're viewing:

TALAY contains no advertising networks, marketing trackers, or user-behavior analytics SDKs. Your data is never sold, rented, or shared for marketing purposes.

3. Your Controls

• Location permission: revocable anytime from your device's Settings app.
• Background tracking: toggle off anytime from the in-app Settings screen.
• Logbook entries and saved areas: delete individually from their respective screens.
• Offline map cache: clear anytime via Settings → "Clear Cache."
• To permanently remove all local data: simply uninstall the app — nothing remains on any server under our control.

4. Children's Privacy

TALAY is not directed at children and does not knowingly collect data from children under 13.

5. Changes to This Policy

This policy may be updated as new features are added to the app. Material changes will be posted on this page.

6. Legal Bases and How Data Is Collected

Your data is obtained directly on your device, by automated or partly automated means, while you use the app. You do not submit it to us through a form or any other channel.

7. Retention

• Data on your device (logbook, routes, areas, markers, tracks, vessel profile, map cache): kept until you delete it or remove the app. There is no time limit because the data is yours, not ours.
• Background position: only the most recent fix is kept; each new one overwrites the last. No history accumulates.
• Anchor Watch: the anchor position is kept on the device until the watch is stowed, then deleted.
• Crash reports (Sentry): for the retention period configured on that project (90 days by default), then deleted automatically.
• Third-party queries (Open-Meteo, OpenTopoData, map providers, Hostinger as talay.app's host): subject to those services' own logging policies, which are outside our control.

8. International Transfers

We operate no server that receives user data, but the services listed in section 2 are established abroad and receive the relevant data when you use a feature:

• Sentry: servers hosted within the European Union (Frankfurt), which provides adequate protection under the GDPR.
• Open-Meteo: Germany / EU.
• OpenTopoData, OpenStreetMap, OpenSeaMap, MapTiler: EU and/or United States.
• Hostinger (talay.app): server location and transfer safeguards are governed by Hostinger's own policy.
• Apple Maps (iOS) / Google Maps SDK (Android): governed by those providers' own policies and transfer safeguards.

These transfers rest on your consent — the location permission plus your use of the relevant feature. No transfer happens if you do not use the feature.

9. Your Rights

Under the GDPR you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21); where processing rests on consent, you may withdraw that consent at any time.

Under KVKK Art. 11 you may learn whether your data is processed and request information about it; learn the purpose and whether it is used accordingly; know the third parties it is transferred to at home or abroad; request correction if incomplete or inaccurate; request erasure or destruction; request that such corrections be notified to third parties; object to a result reached solely by automated analysis; and claim compensation for loss caused by unlawful processing.

You can exercise these directly in the app: because your data lives on your device, you can access, correct and erase it yourself — delete logbook, route or area records, clear the map cache from Settings, revoke the location permission, or remove the app. We hold no copy, so there is nothing for us to action on your behalf.

You may still contact us at the address below. You also have the right to lodge a complaint with the Turkish Personal Data Protection Authority (KVKK) or with the supervisory authority of your EU member state.

TALAY — Política de Privacidad

Este documento explica qué datos procesa la aplicación móvil TALAY (iOS y Android) y con qué finalidad. TALAY está diseñada para funcionar de forma offline por defecto: no existe un sistema de cuentas de usuario y sus datos permanecen únicamente en su propio dispositivo de forma predeterminada.

1. Qué Datos Recopilamos

1.1 Ubicación (GPS)

La aplicación accede a la ubicación de su dispositivo para las siguientes funciones:

• Mostrar su posición en vivo, velocidad (SOG) y rumbo (COG) en el mapa,
• Incluir automáticamente sus coordenadas en los mensajes de socorro Mayday/Pan-Pan,
• Obtener los datos meteorológicos correspondientes a su ubicación actual,
• Adjuntar automáticamente la posición a las entradas del cuaderno de bitácora,
• Comprobar, mientras la Guardia de Fondeo está activa, si el barco ha salido de su círculo de borneo (sección 1.1.2),
• Registrar derrotas (sección 1.1.1).

Su ubicación se almacena en una base de datos local (SQLite) en su dispositivo y nunca se envía a ningún servidor operado por nosotros: no tenemos ningún servidor que reciba datos de usuarios. No obstante, al usar las siguientes funciones las coordenadas consultadas se envían al servicio de terceros correspondiente: abrir la pantalla de Meteorología o crear una entrada del cuaderno envía su posición a Open-Meteo; activar la capa de profundidad envía a OpenTopoData una cuadrícula de coordenadas que cubre el área visible. Los proveedores de mapas también ven la zona que consulta y su dirección IP. Véase la sección 2.

Seguimiento de ubicación en segundo plano (opcional): Al iniciar la aplicación por primera vez, o desde la pantalla de Ajustes, la aplicación le pregunta si desea que su última posición conocida se mantenga actualizada incluso con la aplicación en segundo plano. Esta función está desactivada de forma predeterminada y solo se ejecuta si usted la activa. Cuando está activada:

• Solo se almacena su posición más reciente — se sobrescribe la anterior. Esta función no mantiene un historial de ruta. (La aplicación sí dispone de una función independiente de registro de derrota; véase la sección 1.1.1.)
• Su propósito es que el mapa y la pantalla de emergencia se abran con una coordenada precisa cuando vuelva a la aplicación y, si la Guardia de Fondeo está activa, que la guardia continúe con la pantalla bloqueada (sección 1.1.2). Mientras hay una guardia activa, la posición se toma con más frecuencia.
• Puede desactivarla en cualquier momento desde Ajustes; el seguimiento en segundo plano se detiene de inmediato.
• En Android, mientras esta función está activa, el sistema operativo exige mostrar una notificación permanente por motivos de transparencia — no se puede ocultar, ya que es un requisito de la plataforma Android, no una decisión nuestra.

1.1.1 Registro de Derrota

Aparte del seguimiento en segundo plano, la aplicación dispone de una función de registro de derrota: mientras la aplicación está abierta en pantalla — en cualquier pestaña — registra las posiciones por las que pasa y las guarda en la lista "Derrotas Grabadas". No se registra ninguna derrota con la aplicación en segundo plano. Las derrotas pueden exportarse como archivos GPX (sección 1.5).

• Esta función está activada de forma predeterminada. Puede desactivarla con el botón de derrota en la pantalla del mapa; al hacerlo se cierra el registro en curso y no se escriben más puntos.
• Las derrotas registradas — coordenadas con marca de tiempo y la velocidad en cada punto — se guardan únicamente en la base de datos local de su dispositivo. No se envían a ningún servidor operado por nosotros; no tenemos ninguno.
• Conservación: las derrotas no se borran automáticamente. Permanecen en su dispositivo hasta que usted las borre.
• Borrado: puede borrar cada derrota individualmente desde la lista "Derrotas Grabadas". Al desinstalar la aplicación se borran todas.

1.1.2 Guardia de Fondeo

Al activar la Guardia de Fondeo, la posición del ancla y el radio de borneo elegido se guardan únicamente en su dispositivo. Si el barco ha salido del círculo se calcula en su dispositivo; para ello no se envía ninguna posición a ningún servidor.

• Con la aplicación abierta, la alarma suena en el dispositivo.
• Con la pantalla bloqueada o la aplicación en segundo plano, la guardia solo continúa si el seguimiento de ubicación en segundo plano está activado. La alarma es una notificación local que muestra el sistema operativo de su dispositivo; no interviene ningún servidor de notificaciones. El sistema operativo pide un permiso aparte para mostrarla.
• Al retirar la guardia, la posición del ancla se borra.

1.2 Perfil de la Embarcación

El nombre de la embarcación y el número de personas a bordo (POB) que introduce opcionalmente para los mensajes de emergencia se almacenan únicamente en su dispositivo. Esta información nunca se transmite a ningún servidor; solo se copia a su portapapeles cuando pulsa "Copiar Texto", para que la pegue en su propia radio o aplicación de mensajería.

1.3 Cuaderno de Bitácora y Zonas Guardadas

Las entradas del cuaderno de bitácora que crea (título, notas, junto con el clima y la posición del momento) y las zonas que dibuja y guarda en el mapa (p. ej. fondeaderos, caladeros de pesca) se conservan únicamente en la base de datos local de su dispositivo. Nada de esto se sincroniza con ningún servidor nuestro.

1.4 Datos de Fallos (Crash) y Diagnóstico Técnico

Si la aplicación se cierra inesperadamente, se recopila un informe técnico del error (la ubicación del código donde ocurrió el error, el modelo del dispositivo, la versión del sistema operativo, la versión de la aplicación) a través de un servicio de terceros llamado Sentry, para que podamos diagnosticar y corregir el problema. Estos informes:

• Tienen la posición, el nombre del buque, el POB, el texto del cuaderno y el texto de la llamada de socorro redactados antes del envío: se depuran los campos conocidos, los parámetros de URL y el texto con forma de coordenada. No los enviamos deliberadamente; es una depuración sobre patrones conocidos, no una garantía formal,
• Se envían a servidores alojados dentro de la Unión Europea,
• Se utilizan exclusivamente con fines de depuración.

1.5 Exportación y Uso Compartido

Puede exportar sus derrotas y rutas como archivos GPX y las entradas del cuaderno como texto. Estos datos salen de su dispositivo solo cuando usted decide exportarlos, hacia la aplicación o ubicación que elija en el menú de compartir del dispositivo. TALAY no envía estos archivos a ningún sitio por su cuenta; una vez enviados, se aplican las condiciones de privacidad de la aplicación elegida.

2. Servicios de Terceros

Para ofrecer sus funciones principales, TALAY realiza solicitudes de red a los siguientes servicios de terceros. Como ocurre con cualquier solicitud a internet, estos servicios pueden ver de forma natural su dirección IP y (en el caso de los servicios de mapas) la zona que está visualizando:

TALAY no contiene redes publicitarias, rastreadores de marketing ni SDK de análisis del comportamiento del usuario. Sus datos nunca se venden, alquilan ni comparten con fines de marketing.

3. Su Control sobre los Datos

• Permiso de ubicación: revocable en cualquier momento desde la aplicación de Ajustes de su dispositivo.
• Seguimiento en segundo plano: puede desactivarlo en cualquier momento desde la pantalla de Ajustes de la aplicación.
• Entradas del cuaderno de bitácora y zonas guardadas: puede eliminarlas individualmente desde sus respectivas pantallas.
• Caché de mapa sin conexión: puede borrarla en cualquier momento desde Ajustes → "Vaciar Caché".
• Para eliminar permanentemente todos los datos locales: basta con desinstalar la aplicación — no queda ningún dato en ningún servidor bajo nuestro control.

4. Privacidad de los Menores

TALAY no está dirigida a menores y no recopila conscientemente datos de menores de 13 años.

5. Cambios en Esta Política

Esta política puede actualizarse a medida que se añadan nuevas funciones a la aplicación. Los cambios importantes se publicarán en esta página.

6. Bases Jurídicas y Método de Recogida

Sus datos se obtienen directamente en su dispositivo, por medios automatizados o parcialmente automatizados, mientras usa la aplicación. No nos los envía mediante formularios ni por ningún otro canal.

7. Plazos de Conservación

• Datos en su dispositivo (cuaderno, rutas, zonas, marcas, derrotas, perfil del buque, caché del mapa): se conservan hasta que usted los borre o desinstale la aplicación. No hay límite temporal porque los datos son suyos, no nuestros.
• Posición en segundo plano: solo se guarda la última posición; cada nueva sobrescribe la anterior. No se acumula historial.
• Guardia de Fondeo: la posición del ancla se conserva en el dispositivo hasta que se retira la guardia y después se borra.
• Informes de fallos (Sentry): durante el periodo de conservación configurado en ese proyecto (90 días por defecto), tras lo cual se eliminan automáticamente.
• Consultas a terceros (Open-Meteo, OpenTopoData, proveedores de mapas, Hostinger como alojamiento de talay.app): sujetas a las políticas de registro de dichos servicios, fuera de nuestro control.

8. Transferencias Internacionales

No operamos ningún servidor que reciba datos de usuarios, pero los servicios de la sección 2 están establecidos en el extranjero y reciben los datos correspondientes cuando usa una función:

• Sentry: servidores alojados en la Unión Europea (Frankfurt), que ofrece protección adecuada conforme al RGPD.
• Open-Meteo: Alemania / UE.
• OpenTopoData, OpenStreetMap, OpenSeaMap, MapTiler: UE y/o Estados Unidos.
• Hostinger (talay.app): la ubicación del servidor y las garantías de transferencia se rigen por la política propia de Hostinger.
• Apple Maps (iOS) / Google Maps SDK (Android): se rigen por las políticas y garantías de transferencia de dichos proveedores.

Estas transferencias se basan en su consentimiento: el permiso de ubicación y el uso de la función correspondiente. Si no usa la función, no hay transferencia.

9. Sus Derechos

Conforme al RGPD tiene derecho de acceso (art. 15), rectificación (art. 16), supresión (art. 17), limitación del tratamiento (art. 18), portabilidad (art. 20) y oposición (art. 21); cuando el tratamiento se base en el consentimiento, puede retirarlo en cualquier momento.

Conforme al art. 11 de la KVKK puede saber si sus datos se tratan y solicitar información; conocer la finalidad y si se usan conforme a ella; conocer los terceros a los que se transfieren dentro o fuera del país; solicitar su corrección si son incompletos o inexactos; solicitar su supresión o destrucción; pedir que dichas correcciones se comuniquen a terceros; oponerse a un resultado obtenido únicamente mediante análisis automatizado; y reclamar por los daños derivados de un tratamiento ilícito.

Puede ejercerlos directamente en la aplicación: como sus datos residen en su dispositivo, usted mismo puede acceder a ellos, corregirlos y borrarlos: eliminar entradas del cuaderno, rutas o zonas, vaciar la caché del mapa desde Ajustes, revocar el permiso de ubicación o desinstalar la aplicación. No conservamos ninguna copia, por lo que no hay nada que debamos tramitar en su nombre.

Aun así puede escribirnos a la dirección indicada abajo. También tiene derecho a presentar una reclamación ante la Autoridad Turca de Protección de Datos (KVKK) o ante la autoridad de control de su Estado miembro de la UE.
